Connection Requirements - Building and Placing Fibre
To effectively build or place fibre in any community, the following should be considered:
- The Service Provider is at liberty to secure fibre for this connecting arrangement, where available, from commercial sources such as; Canadian Carriers (ex: TELUS, Bell) or from a Canadian cable television company.
- If the Service Provider is unable to secure cost-effective commercial fibre, construction may be necessary. If so, there are many competent and qualified contractors that could competitively engineer and construct local fibre for the connection to SuperNet, as well as, any other local distribution fibre that may be required by the Service Provider. Axia recommends that only experienced and qualified contractors be employed to provision fibre.
- If a Service Provider site is situated next door to a SuperNet PoP or MMF, direct access to the PoP or MMF fibre demarcation may sometimes be achieved without requiring access to duct or pole line support structures of TELUS, or other utility company such as EPCOR. For that matter, in many cases throughout remote rural Alberta there simply will not be any duct or pole line support structures to utilize. There always is the Public-Right-Of Way which can be used by those obtaining any and all agreements, required permits and authorizations.
- If access and use of duct or pole line support structures of TELUS is required, TELUS may not act upon a Service Provider request for access and use of duct or pole line support structures, nor might other utility or cable companies, unless the Service Provider has registered as a non-dominant carrier and been confirmed by the Canadian Radio-television and Telecommunications Commission (“Commission”). Upon confirmation as a non-dominant carrier by the Commission, the Service Provider’s name will be added to the list of non-dominant carriers. Note: a confirmation of that likelihood is evidenced by the following quote from the TELUS General Tariff CRTC 21461, Item 404, Support Structure Services wherein a Licensee is defined has been provided:
- “ ‘Licensee’ means a cable television undertaking duly licensed or exempted by the Canadian Radio-television and Telecommunications Commission or a Canadian carrier as defined under the Telecommunications Act (Canada), that has been granted License pursuant to the terms and conditions of this Tariff Item.
- Permit requirements
- Where a Service Provider plans to place any local fibre, the Service Provider must also obtain and maintain any and all necessary permits, authorizations, and agreements.
- Where a Service Provider plans to use wireless local distribution to reach its customers, the Service Provider must also obtain and maintain any and all necessary permits, authorizations, and spectrum licences
